The Jones Act is officially titled the Merchant Marine Act of 1920 and was written to promote and protect American built, owned and staffed ships and formalize the rights of the merchant marine, or seaman. The act allows a seaman to file claims against their employer and recover damages resulting from the negligence of the shipowner, the captain, or crew members.

Who is eligible for benefits?

Generally, anyone who spends 30% of their time in service on the water is considered a seaman under the Jones Act. They can be workers on a wide variety of vessels including: Container ships, Oil tankers, Tugboats, Crew boats, Barges, Derrick barges, Jack-up rigs and Semi-submersible rigs.

Injuries can arise from explosions, falling pipes, slip and falls and defective tools and machinery, just to name a few. If you are a Rig Superintendent, Crane Operator, Roughneck, Floorhand, Roustabout, Pilot or Blue Water Seaman and have suffered an injury while on the job, you may be eligible for benefits.
